OPEN BURNING LAW:        3745-19.03-

            No person shall cause or allow open burning unless having the criteria listed below.

 

DEFINITIONS:

Open Burning:               Fire Code 302.1

            The burning of any materials wherein products of combustion are emitted directly into the air without passing through a stack or chimney from an enclosed chamber.  The current interpretation of the local EPA authority states that chimineas and other wood burning devices do not constitute a legal open burn, unless utilized for cooking purposes.

 

Bonfire:                        Fire Code 302.1            

            An outdoor fire utilized for ceremonial purposes.  A bonfire shall not be more than 5' x 5'x 5' in dimension.  A legal bonfire requires written permission from the EPA 10 days in advance of the fire.  Notification to the East Sparta Vol. Fire Dept. with receipt of copy from the EPA permit is required prior to the bonfire.  Dispatch must be notified at the time of lighting of the bonfire, advising them of time and duration of bonfire at 330-866-9211.

 

Cooking Fire:                 Fire Code 302.1

            An outdoor fire utilized to cook food for human consumption. A cooking fire shall not be more than 3' x 3' x 3' in dimension.

 

Recreational Fire:          Fire Code 302.1

            A non-cooking fire utilized for recreational purposes.  A recreational fire shall not be more than 3' x 3' x 3' in dimension.

OPEN FLAMES OR BURNING:

 

F-307.2.2-         Open Burning Prohibited:          

            The fire official shall prohibit open burning that will be offensive or objectionable due to smoke or odor emissions when local circumstances make such fires hazardous.  The fire official shall order the extinguishments, by the occupant or the fire department, of any open burning which creates, or adds to, a hazardous or objectionable situation.

 

F-307.3.1-                     Location:

                        The location for any bon fire shall not be less than 50' from any structure or combustible material, and shall be made to prevent the fire from spreading to within 50' of any structure.  The location of cooking & recreational fire shall not be less than 25' from any structure or combustible material, and shall be made to prevent the fire from spreading to within 25' of any structure. 

 

F-302.1                         Materials:

                        Open burning shall not be utilized for waste disposal purposes, and shall be of clean, dry wood only.

 

F-303.4                         Attendance:

F-303.5             Any open burning shall be constantly attended until the fire is extinguished and at least one portable fire extinguisher or other approved on-site fire extinguishing equipment shall be available for immediate utilization if needed. 

 

  • The East Sparta Vol. Fire Dept. investigates all open burn complaints and contacts the local EPA authority for enforcement.   
  • Excessive open burns, with complaints being received by the fire department, shall be classified as a "nuisance" and the applicable laws will be enforced.
