PIKE TOWNSHIP TRUSTEES SPECIAL HEARING
May 12, 2008 - 7:30 p.m.
Trustee President, Douglas Baum opened the meeting at 7:30 p.m. Carol Barto read the legal ad that was published in The Press News, May 1, 2008. Attorney, Charles Hall instructed the Trustees that any action they take different than the Zoning Commission, whether to accept, deny or modify the applications would require a unanimous vote of the Trustees.
FIRST ORDER OF
BUSINESS -
VOTE:
Lee Strad, yes
Douglas Baum, yes
Vote was unanimous to deny the zone change. Zone change was denied.
SECOND ORDER OF
BUSINESS -
Harriet Beabout, representative of the Deel family stated that septic had been approved by Stark County Health Dept. for commercial use of this property and that was the reason the Zoning Commission had denied the zone change.
Richard Hamilton of “All Construction” stated that he had
planned to buy the property and construction a 50’ x 100’ building to house his
construction equipment in the lower level and have a bulk food store in the top
level, facing
Anita Tripp, who resides at
Mr. Hamilton stated that, for now, he only planned to have two full time employees for the cabinet making part and the bulk food store was only an idea he had for the upper level, and he had no immediate plans.

After the Trustees discussion, Lee Strad made a motion to
accept the Zoning Commission’s recommendation for denial. Seconded by

The vote was two to one to deny the zone change. Zone change denied.
THIRD ORDER OF BUSINESS: Test Change to add surface and strip mining, as a conditional use, to B-1 and B-2 Commercial Districts. Applicant, Wayne Wood.
Attorney Charles Hall, again reminded the Board that the
business at hand was a text change, and that he had previously recommended the
change to the Zoning Commission, when they were considering the Zone Change for
the City of
Attorney Rex Miller represented Mr. Wood and again reminded the Board that a text change was applicable for the Commercial District and that most other Townships allowed strip or surface mining in Commercial Districts and that the Trustees should not treat this application as “a popularity contest”.
Numerous Ferndale Allotment residents, as well as East
Sparta Village Mayor and residents spoke in opposition to the text change,
stating that they just did not want mining on the Wood property. Only one person, Anita Tripp commented that
she presently lived with 100 feet of a sand & gravel mining operation and
there were not adverse affects. She also
stated that the
Attorney Miller again stated that the comments presented were not applicable to the text change and the change would be fair to all of the township residents. Attorney Hall, representing the Township stated that, based on the comments, he would recommend that the Trustees consider allowing the mining, with more stringent regulations.
Trustee, Charnetzky commented that thirteen or the seventeen
townships in

The vote was two to one to accept the Zoning Commission recommendation. The text change was denied.
