BOARD OF ZONING APPEALS HEARING       

May 27, 2008 - 7:00 p.m.

7134 East Sparta Avenue S.E., East Sparta, OH

 

Members present were Jerry Werner, Audrey Malavite, Louis Grooms, Bob Miller and Bob Burkhart, presiding.  Also present were Zoning Inspector, Sharon Perrine, Zoning Secretary, Carol Barto, Trustee Doug Baum and four interested persons.

 

Mr. Burkhart opened the meeting introducing the Board, setting with two alternates.  Mr. Burkhart asked if there were any corrections to the previous meeting minutes.  None were noted and the Zoning Secretary read the introduction to the board and the legal notice published in The Press News May 13 & corrections May 22, 2008.

 

 

APPEAL #343

 

Marc Karam of 7885 Cleveland Ave. S.E. is requesting a 29 foot rear setback and a 9 foot side setback variance, from the required 30 foot rear and 10 foot side setback as required by the Township Resolution, to construct an accessory building located in the S.E. Qtr. Sec. #14 of Pike Township.

 

Mr. Burkhart asked Mr. Karam to explain his request.  Mr. Karam purchased an 8˝ foot x 10 foot storage shed, not knowing he had to get a zoning certificate, he placed the building one foot in from the rear and side property lines, to keep it in line with the present garage.

 

Mr. Burkhart asked if anyone was in opposition or wanted to comment.  Frances Miller, who resides at 7883 Cleveland Avenue, next to Mr. Karam stated she objected to the building being too close to her property and if, at any time, they wanted to erect a fence, it would be impossible to maintain their fence, as well as Mr. Karam to maintain his building.

 

Mr. Grooms asked Mr. Karam if he could move the shed closer to the other buildings.

 

Mr. Karam stated that he wasn’t allowed to place it that close to his propane tank that it would create a safety hazard

 

Zoning Inspector, Perrine asked Mrs. Miller if Mr. Karam was willing to move the building a couple feet, if that would enough to meet their requirements.  She also stated that, because of the tree in front of the building, as per her photographs, the shed could not be moved more than a few feet, without destroying that tree. 

 

Mrs. Miller said that, as long as Mr. Karam would move the building three feet from the property line, they would have enough room to maintain their property, she would be in agreement to the variance.  

 

Bob Miller made a motion to grant a variance for 3 feet from the back and side property lines, making the variance a 7 foot side and a 27 foot rear setback variance.  Seconded by Louis Grooms.

 

VOTE:                                   Jerry Werner, in favor of variance.

 

                                                Audrey Malavite, in favor of variance.

 

                                                Louis Grooms, in favor of variance.

 

                                                Bob Miller, in favor of variance.

 

                                                Bob Burkhart, in favor of variance.

 

Vote was unanimous to grant a 27’ rear and a 7’ side setback variance.

 

OTHER BUSINESS:

 

Zoning Inspector, Sharon Perrine notified the Board that the Township won the law suit of Brown vs Pike Township Board of Zoning Appeals  in regards to Valley Mining.
