PIKE TOWNSHIP BOARD OF ZONING APPEALS
August 20, 2008 –
7:00 p.m.
Members present were Nancy Snyder, Audrey Malavite, Louis Grooms, Jerry Eibel,
and Bob Burkhart, presiding. Also
present were alternates Bob Miller and Jerry Werner; Zoning Inspector, Sharon
Perrine, Trustee, Doug Baum, David Ross and Zoning Secretary, Carol Barto.
Mr. Burkhart opened
the meeting at 7:00 p.m. requesting any Zoning Business be presented. Sharon Perrine, Zoning Inspector, informed
the Board that she had talked with a representative of Valley Mining regarding
Scott Brown’s concern about the mining company testing the water wells in the
vicinity of the Durskey property. She was told that they weren’t sure yet if
blasting would be necessary on the property and until that if they determined
that blasting was necessary to extract the coal, the property owners within the
required limits would be notified and they will have the opportunity to request
a pre-blasting survey.

Ms. Perrine stated
that Mr. Marcum was not available to plead his case, so she represents the Marcums for the variance.
She went on to show the photos she had taken of the property and the
location of the pool, as well as the hillside behind the house.
Nancy Snyder asked
if the pool would stay in the present location.
Ms. Perrine stated that, if the Board granted the variance, they could
stipulate the pool stay in that location.
Jerry Eibel stated he had no objection of the
pool, but stated that they should not be allowed to put a building in that spot
if the pool was no longer in use.
Jerry Eibel made a motion to grant the variance for a swimming
pool in the front yard area on the condition that if the pool was no longer in
use, no other structure could replace it.
He also stated that the seven (7) “Practical Difficuilties”
as stated in ORC 519.14 (B) do indeed apply in this situation. Seconded by Nancy Snyder.
