PIKE TOWNSHIP BZA MEETING

June 13, 2007 - 7:00 p.m.

7134 East Sparta Ave. S.E., East Sparta, Ohio

 

Members present were Nancy Snyder, Audrey Malavite, Louis Grooms, Jerry Eibel and Bob Burkhart, presiding.  Also present were alternates Robert Miller and Barbara Harding.  Zoning Inspector,  Sharon Perrine, Zoning Secretary, Carol Barto and ten (10) guests.

 

Mr. Burkhart opened the meeting introducing the Board members and asking for any additions or corrections to previous meeting minutes.  The definition introduction to the board was presented to each guest in attendance.

Mr. Burkhart asked Mr. Liebi to explain why he needed the 23 foot setback variance.

He stated that he wanted to buy the property and has contacted the Stark County Health Department and Griffith to test the soil for septic.  He stated he was told by both the Health Department and Mr. Griffith that there was only one type of  septic system that could be installed on the premises and the location of such a system would place his intended house too close to the front of the property (27’ from Road Right-of-way).

 

Zoning Inspector, Sharon Perrine addressed the Board and stated that she had been to the property with Debbie Moore, of the Stark County Health Department was recommending the angle of the house to get away from the well and that the old well would have to be properly abandoned.  Ms. Moore stated that the ground in the front would not support the septic system, as it had been disturbed by the previous septic system.

 

OPEN DISCUSSION:

 

Neighbor, Ralph Fulmer, expressed his concern that the lot was too small to support a septic system and would affect his shallow well (19’) and was against someone building on that lot, as the new septic would be above grade from his well.  Mrs. Casto questioned why the former owner, whose house had burned, was not allowed to rebuild on that lot.  Mr. Burkhart stated that he had been on the Board for many years and he did not remember anyone requesting a variance before.  (note:  when sec’y checked  prior records, it was found that the previous owner had requested a variance to put a mobile home in place of the burned house).  Several other neighbors stated that they had moved out in the country to get away from close neighbors and were against the construction of a home on that lot. 

 

Following Board deliberation, Louis Grooms made a motion to grant the 23’ variance to comply with the 50’ setback as required.  Seconded by Audrey Malavite.

 

VOTE:                                   Jerry Eibel, voted to grant the 23’ variance.

 

                                                Louis Grooms, voted to grant the 23’ variance.

 

                                                Audrey Malavite, voted to grant the 23’ variance.

 

                                   Bob Burkhart, voted to grant the 23’ variance.

 

                                   Nancy Snyder, voted against granting the 23’ variance.

 

Vote was split, four in favor of granting variance and one against the variance.

 

 

OTHER BUSINESS

 

Jerry Eibel questioned Zoning Inspector, Sharon Perrine, about the status of the Stanley Miller property.  Ms. Perrine stated that Mr. Miller’s attorney felt they were in compliance with the court order, but Ms. Perrine  felt they were not in full compliance and has taken photos and given to the Township Attorney, Charles Hall, to show that some junk equipment had not yet been removed, as well as the fence was still not completed.

 

Jerry Eibel also questioned Zoning Inspector Perrine about the John Heade, Jr. property on Ridge Ave.  Ms. Perrine stated that Attorney Hall and Trustee, Doug Baum were scheduled to inspect the property at 4:00 p.m. this date and she had not yet heard the results of that inspection.  The judge had given him another week to comply with the court order.

 

Nancy Snyder made a motion to adjourn the meeting.  Seconded by Audrey Malavite.  The meeting was adjourned at 7:30 p.m .
