BOARD OF ZONING APPEALS
May 9, 2007 -
7:00 p.m.
Board members present were:
Nancy Snyder, Audrey Malavite, Louis Grooms,
Bob Miller and Jerry Eibel, presiding. Also present were Alternate, Barbara
Harding, Zoning Inspector, Sharon Perrine, Zoning Recording Secretary, Carol
Barto and six interested persons: Robert
& Ruth May, Kevin Davis, Wayne & Frances Kiser and Florence Mallott.
Mr. Eibel opened the meeting asking Mrs. Malavite
to read the ad as published in The Press News, April 19, 2007.

Frances Kiser (POA) for Ines
A. Yockey owner of property located at
Mr. Eibel asked if Mrs. Yockey or a
representative was present. Frances
Kiser stated she was representing her mother, Mrs. Yockey,
and had a power of attorney to act in her behalf. Mrs. Kiser said they had auctioned the
property, on the condition a variance would be granted for a frontage
difference. Two separate individuals
had purchased the two parcels. The
larger parcel (11 acres) was purchased by an adjacent property owner, and they
just needed a variance for the smaller parcel (2.99 acres) that currently had
only a 67 foot frontage onto
Sharon Perrine,
Zoning Inspector addressed the Board and stated that she had talked to Reva Butera, in Stark County
Regional Planning, who researched the property and found that the parcels had
been in existence since the 1940’s. Mrs.
Butera recommended that the variance be granted by
the Board, because it could be deemed non-conforming by the Court System.
After open
discussion by the public, the Board deliberated. Louis Grooms made a motion to grant a
thirty-three foot (33’) frontage variance for Parcel #4800489 (2.99)
acres. Nancy Snyder seconded the motion.
VOTE: Nancy
Snyder, in favor of frontage variance.
Audrey Malavite, in favor of frontage variance.
Louis
Grooms, in favor of frontage variance.
Bob Miller, in favor of frontage variance.
Jerry Eibel, in favor of frontage
variance.
Vote was unanimous to grant a thirty-three foot
(33’) frontage variance for Parcel #4800489.
OTHER ZONING BUSINESS
Sharon Perrine
asked that the Board members, who could, attend a meeting at the Township Hall
on Monday May 14th at 8:30 a.m. to meet with a geologist regarding
affects, if any, a lake on the
Audrey Malavite made a motion to adjourn the meeting. Nancy Snyder seconded the motion. Mr. Eibel adjourned
the meeting at 7:33 p.m.
