Regular Meeting

 

President Lee Strad called the meeting to order at 7:30 p.m.  Trustees Doug Baum and Bob Anstine were present as well as Clerk Steve Knox.  Others in attendance were Louis & Violet Grooms, Nancy Cramer, David Ross, Joe Barnes, Jerry Young, Gary Banta, Alice Banta, James and Terri Davis, Tim Vandersol, Steve Karas, Tom O’Dell, Richard Mahoney, Bill Farrick, Steve Diloreto, Gary Knepper Jr.,  Homer & Julie Collins, and Nancy Collier.

 

A motion was made by Anstine to accept the minutes and financial report as presented.  Seconded by Baum.

1st Public Speaks Session

 

Alice Banta is asking for the continued support of the Township Trustees for the on and off ramp in the name of safety for the neighbors and friends of all who live by the landfill. 

 

Gary Banna stated that he feels the same way that the ramp needs put in for safety.  He doesn’t understand why anyone would be against the ramp.

 

Tom O’dell requested that if there is a special meeting, that Club 3000 be put on the list to be notified.  Based on the ORC, the community has the right to be placed on a special notification list that if there are any special meetings, they be notified by the Township in a timely manner.

Also, he wanted to let everyone know that Club 3000 has not been conducting survey’s in the area.

 

He went on to state that he is in total agreement that the roads are a hazard, but everyone needs to understand the whole story to understand why some people are against the ramp.

 

There was a questions as to the status of Lee Strad at a community meeting as to whether he went as a resident or a representative of Pike Township.  Strad stated that he announces before he says anything at meetings as to whether he is there as a representative of the Township Board, or as a resident.

 

O’Dell then asked why the Pike Township Trustees have not donated anything toward the ramp.  Strad stated that since we started receiving tipping fees of $0.25 cents per ton we have received about 2.5 million dollars total over the last 10 years, so as you can see, it would take a lot of years before we would be able to give even a little since the ramp is going to cost between 15 to

20 million dollars.  Also, there are other Government Boards receiving a lot more money from tipping fees.(Clerk Note:  Including the Waste District at $1.00 per ton)

 

Linda Harvey from Bolivar asked if they(the Trustees) get any reports on the odor control if there is a complaint?  The Board stated that they did not unless the resident included them in the complaint.  She is requesting that the Board request to be notified on all odor control problems.

 

David Ross asked about getting recycle bins at Fohl Village.  Baum stated that he would ask about getting recycle bins but the last time he checked, they were not going to have another recycle center.

 

Mrs. Davis stated that the odor on the northwest end of the landfill has been very bad.  Can the odor control system be turned on when the weather is warm enough? 

 

Tim Vandersol stated that it is hard to turn it on, and then turn it off when the weather drops.  They will be meeting Monday with a company about putting more gas wells in to help alleviate the odor.

 

Also, the slime on the road at Gracemont is getting worse.  Vandersol stated the wheel wash went down a few days ago, so it has been worse, but the water truck and street sweeper have been out to help alleviate this problem.

 

Her next question was about the ramp.  She is curious to know if there is any update on the placement of the ramp.  Strad stated that nothing has been discussed since the initial meetings because of the funding issues.

 

Vandersol stated that ODOT is on hold until the agreement is signed after the district brings back the money they initially appropriated.

 

New Business

 

A motion was made by Anstine to go into executive session for pending litigation at 7:52p.m.  Seconded by Baum.

A motion was made by Anstine to adjourn executive session at 8:44 pm.  Seconded by Baum.

 

Strad stated the following, Judge Sinclair’s judgment entry on 01/04/2006 gave the Trustees the option of making a motion to the Court to approve a settlement of Case No. 2004-CV-02705. 

I(Strad) am making a motion to authorize our Counsel to make such a motion.

A motion was made by Anstine to go into executive session to discuss personnel matters with Gary Knepper Jr. and the Union representatives at 8:45 p.m. with the possibility of a grievance agreement.  Seconded by Baum.

 

A motion was made by Anstine to adjourn executive session at 9:20p.m.  Seconded by Strad.

 

A motion was made by Anstine to accept the mutual agreement that was reached.  Seconded by Baum.  Strad agreed.

 

Old Business

 

A motion was made by Strad that the Township will cover the expenses for the Government Law Seminar on Saturday, February 25th at the Holiday Inn from 9:00 a.m. to 2:00 p.m. for any of the BZA or Commission members.  They should pay there own way and then the Township will reimburse them.  Seconded by Anstine.

 

 

The Trustees would like to go ahead and repair the Furnace at the Fire Station.

 

Strad stated that the 5th district court of appeals gave a verdict on the Stanley Miller case.  They upheld the decision concerning the cleanup and agreed that they are still in violation and the fines are upheld.  The fines are $32,000 and continuing at $100.00 per day.

Road Report

 

Chipping brush on Brinker and Kkeifer.

Ran drag on all gravel roads.

Dropped a tree on a car.  The Clerk stated that our insurance company stated that per the Ohio Revised Code, the Township is only responsible for the deductible.  In this case, she didn’t have any so the full responsibility except for the car rental expense is on her insurance company.  The Clerk will do a follow-up call tomorrow.

Pahanish asked if we are going to purchase a new Steiner this year.  Strad stated that the program is not as lucrative as before.  Our current one has about 200 hours on it.

Pahanish stated that he received a quote for $5,200 for a new one after trade in.  The Trustees asked him to bring it to the planning meeting in February with his wish list.

 

J&D Mining requested a letter on letterhead stating the amount of stone that we will be purchasing this year.  Pahanish stated that we need 1000 tons of 57’s and a 1000 tons of 8’s.

 

January 25th  Marlboro Supplies is putting on a pipe/culverts/catch basin clinic from 10:00 to 1:00 at the Plain Township Garage.  The Trustees agreed that this would be something that Pahanish should go to.

 

The Trustees think that all of the Road Crew should take the Class A test.

 

Pahanish stated that the inventory list is done.  Knox requested a copy of the list.
