FINDINGS OF FACT

Stanley Miller Construction

2250 Howenstine Dr. S.E.

East Sparta, OH  44626

 

As directed by Judge Sara Lioi, Stark County Common Pleas Court in the Judgement Entry, Case No. 2005CB01989, dated January 17, 2006.

 

“The law in Ohio requires a township board of zoning appeals, in determining whether or not to grant an application for an 25% expansion of land use, to make findings of fact, supported by a preponderance of reliable, probative and substantial evidence.  Pike Township’s Zoning Resolution states general and specific standards to meet for non-confirming use certificate (Section Ten, Title II) for contractor’s business in a B-2 Commercial District.” ; and ORC 519.19. 

 

The evidence and past experiences with Stanley Miller Construction, does not support the following:

 

Nancy Snyder:  “I’ll make a motion to deny – deny the expansion based on that the character of the neighborhood would be altered and it would suffer a detriment as a result of the expansion, and I believe that the spirit and the intent of the zoning would not be observed by Miller Construction if the expansion was granted.”

 

In the past, Stanley Miller Construction has refused to adher to the spirit and intent behind the zoning requirement as stated in Section Five, Title II, B, (15) (a) and (b) of the Pike Township Zoning Resolution.

Nancy Snyder in favor of denying 25% expansion of Stanley

                        Miller Construction business use of property.

 

Audrey Malavite in favor of denying 25% expansion of Stanley

                        Miller Construction business use of property.

 

Louis Grooms in favor of denying 25% expansion of Stanley

                        Miller Construction business use of property.

                       

Bob Burkhart in favor of denying 25% expansion of Stanley

                        Miller Construction business use of property.

 

Robert Miller in favor of denying 25% expansion of Stanley

                        Miller Construction business use of property.

 

 

VOTE was unanimous to deny Stanley Miller Construction an expansion of 25% for business use of property located at 2250 Howenstine Dr. S.E., East Sparta, OH  44626.
