BOARD OF ZONING APPEALS
January 31, 2006 – 7:00 p.m.
Members present
were Nancy Snyder, Audrey Malavite, Louis Grooms, Bob
Burkhart, Jerry Eibel, and alternate Barbara
Harding. Also present were Zoning Inspector,
Sharon Perrine, Zoning Secretary, Carol Barto and six
(6) interested persons.
Mr. Burkhart opened the
meeting at 7:00 p.m., introducing the Board Members and requesting a motion to
enter into Executive Session with Township Attorney, Charles Hall to discuss
pending litigation. Nancy Snyder made a
motion to enter into Executive Session. Seconded by Audrey Malavite. Roll call vote was unanimous.
At approximately 7:20 p.m.
the Board returned to Regular session with Louis Grooms making a motion to
return. Seconded by
Nancy Snyder. Roll call vote was
unanimous. Audrey Malavite
then read the Legal Ad as published in The Press News January 20, 2006. Secretary Carol Barto
had handed a written copy of the Introduction of the Board to members of the
audience, for them to read, during the Executive Session. So it was not read aloud at this time.
First order of business, Mr. Burkhart asked if Mr. Van Dee was present and
asked him to explain his intentions for the Conditional Use. Mr. Van Dee explained that, at no time, did
he instruct more than four divers, as a safety factor, and most of his business
was conducted other than the residential property and that he would not employ
other persons for this business.
Mr. Burkhart read the list of
adjacent property owners and the only ones present were Mr.
& Mrs. Harry Mayhew. Mr.
Burkhart asked them if they had any questions or comments to make to Mr. Van
Dee. Mr. Mayhew asked why Mr. Van Dee
could be permitted to have a business at the residence, when Ridge Electric was
not permitted. Mr. Burkhart explained
that Ridge Electric was a larger and different type of business. After much discussion, Mr. Mayhew said he
didn’t have an objection to the Van Dee’s having a business but still couldn’t
understand why Ridge Electric couldn’t have a business at this location.
The Board discussed the
proposal and Louis Grooms made a motion to grant the Conditional Use for a home
occupation with a sign variance to install a 4’ x 4’ x 4’ sign at the entrance
to the property.
Seconded by
Audrey Malavite.
Roll call vote
was unanimous to grant the Conditional Use Certificate and sign variance.
No other Zoning Business was
brought before the Board.
Nancy Snyder made a motion to
adjourn the meeting. Seconded
by Audrey Malavite. The meeting was adjourned at 7:45 p.m.
