BOARD OF ZONING APPEALS MEETING

October 30, 2006 - 7:00 p.m.

7134 East Sparta Ave. S.E., East Sparta, Ohio

 

Board members present were:  Nancy Snyder, Audrey Malavite, Louis Grooms, Jerry Eibel and Bob Burkhart presiding.  Also in attendance were Trustees, Doug Baum and Lee Strad;  Zoning Inspector, Sharon Perrine and twelve (12) interested parties.

 

Bob Burkhart opened the meeting by introducing the Board members.  Audrey Malavite read the legal ad that appeared in The Press News October 12, 2006.

Mr. Burkhart asked if a representative was present.  Mr. Ted Fetters said that he would represent the baseball association, as well as Thom Krupar would be representing the baseball association, as well as the Miller family, who was providing the property for the ball fields.

 

Mr. Fetters was sworn in and explained the association’s proposal for the construction of two (2) fields, at the present time, and the locations of those fields.  He also said that Mr. Krupar was representing the Miller family and was involved in the association.  He went on to explain that parking would be on the property and no parking would be on Stinewood Drive. 

 

Mr. Krupar, representing the Miller family, as well as being a part of the association, explained further details of the parking area and the ingress and egress road and where it was located on the property. 

 

Several of the residents of Stinewood Drive, Mr. & Mrs. Murphy, Lloyd D. Milton and Cris Henrix expressed their opposition to the ball fields, stating their concerns that many of the small children in the area play in the streets and with the road being so narrow and the increased amount of traffic, their children would be at risk.

 

Mr. Fetters and Mr. Krupar stated they would be willing to install signs warning of children at play, as well as, entrance and exit routes for the traffic and plant foliage to block balls from leaving the propertyand creating hazards for local property owners.

 

Johnny Miller and his family expressed their approval of such a facility in the Township, stating that Canton South Baseball Association is a good organization that maintains their facilities and does a lot of good things for the children in the community.  Also in the fifty or so odd years he has worked with the group he has never had to clean up after them, nor has there been disciplinary problems at his field on south Cleveland Avenue.

 

Audrey Malavite made a motion to approve the Conditional Use Certificate with guidelines of Section Four, Title I (C), (2) and the conditional proper signage and adequate foliage be installed.  (Private or publicly operated picnic areas, playgrounds, parks, swimming facilities, golf courses, tennis clubs, country clubs, riding academies and fishing facilities and/or uses, subject to subsections (1), (2), (3), (5), (10), (12, (13), (14), (15), (17), (32), (44) and (52).)  Seconded by Jerry Eibel.

Vote was unanimous to grant recreational Conditional Use Certificate.

 

OTHER BUSINESS;

 

Charles Hall, requested to address the Board concerning the processes being implemented with Countywide Landfill and the odor problem.  He explained that the jurisdiction was in the hands of the EPA and the Health Departments and until they have completed their investigations and made their suggestions, the Trustees would be wasting money and time to hire the experts needed at this time.   The Board of Appeals cannot act on anything until the Landfill has actually broken a zoning regulation.

 

Mr. Hall went into great detail of the processes and as soon as actions and/or decisions have been taken by the EPA and/or the Health Departments, then the Trustees may have an option to act, but until that time it would be waste of time and taxpayer money to file suit against the Landfill.

 

Louis Grooms made a motion to adjourn the meeting at 8:10 p.m.  Seconded by Nancy Snyder.  The Meeting was adjourned.
