Regular Meeting

President Lee Strad called the meeting to order at 7:30 p.m. Trustees Bob Anstine and Doug Baum were present, as well as Clerk Steve Knox. Others in attendance were Road Supervisor Mark Pahanish, Louis Grooms, Nancy Brunoni, Michael Abrams, Homer & Julie Collins, Rita Klever, Linda Zaleski, Alison Roberts, James and Terri Davis, Fred Charton, Brenda Chater, Tom and Sue O’Dell, Mary Bair, Mary Vincent, Eric Sachs, Gary Franks, Maryann Learn, Jill VanVonhis, Vivian Baier, Philip Revlock(Solid Waste Division-Stark County Health Dept.), Kirk Norris(Environmental Health Dept.-Stark County Health Dept.), Bill Franks(Director-Stark County Health Department), Dave Collier(Press News), Nancy Cramer, Pat Shriver(Canton City Health Department), Wayne Casto, Wil Lonner, Nancy Cramer, Nancy Snyder, Joe Barnes Sharon Perrine.

A motion was made by Anstine to accept the minutes and financial report as presented. Seconded by Baum.

Strad opened the meeting by telling everyone that he knows this is a very passionate issue, but this is meant to be informative only, and if things get out of hand he will not hesitate to send the representatives home from the Stark County Health Department, as well as the Canton Health Department.

Strad stated that the reason why they are here is to talk about Countywide Landfill and the ongoing issues, as well as corrective actions that are currently being attempted.

Bill Franks, the Director of Stark County Health Department, introduced himself and then handed it off to Kirk Norris to discuss the odor problem as well as other issues pertaining to the Countywide Landfill. Kirk discussed in detail the new odor control system that his office has determined necessary for Countywide to keep their annual license renewed. Countywide agreed and they are to have it in by May 2005. He also answered the question of what happens if they don’t have it in by May 2005. He said they would probably get an extension as long as there was determined to be a reasonable effort made to implement the system by the date given. If not, there license to operate could be suspended.

Strad stated that within the last year, the odor seems to have gotten worse. Their department believes it is worse due to the elevation increase over the past few years.

He went on to state that as soon as the weather breaks, the gas extraction system will be up and running, but until then, the gas odor will most likely get worse before it gets better.

Strad wanted to re-iterate that we are talking about air odor and not air quality tonight.

He went on to state that this is why the Board invited the Canton Health Department. They manage the air quality using a nuisance law. They were investigating but have since put their investigation on hold until they see whether the new odor control system will work. If it doesn’t work, their board would then make them try something else.

This would be from a health and an odor standpoint.

Mr. Ruben asked if the Landfill has been defined as a public nuisance. The answer from the Canton City Health Department was yes they have.

Mr. Ruben went on to ask whether this could stop the expansion since adding more trash would only make it worse. The CCHD stated that nothing is in the current regulations on odors that would stop an expansion.

They went on to state that if the odor control system doesn’t work, the city would look into it and make them try something else. Ultimately, they could lose their license but odor alone could not shut the landfill down. Bill Franks stated that people can’t confuse odor and air pollution.

To clarify, Bill Franks stated that the conditions in place are that they just have to have it in. There is no quantifiable law that says an odor can shut a place down. There is also the issue of how do you measure it. One person’s idea of a bad odor is not another persons. It is very difficult to measure. What they can do is an odor survey and identify the different view points of the public surrounding the area.

They are also mandated to burn off the methane gas that is coming from the ground. They are currently putting 37 wells in and are only 15.

Nancy Brunoni asked why they are so far behind on putting the wells in. The answer from the Health Department stated that they are actually right on schedule.

Tom Odell asked about the landfill leach aid. In the last year and half, he is concerned about the leaching since the cells are now higher. He is noticing more leaching than what he perceives as normal. They have made some repairs, but there is still some leaking. The Health Dept. stated that they have also seen the leaching and noted that they probably wouldn’t be completely fixed until the weather breaks.

If someone has an odor problem, they can call or email Kirk Norris at the Stark County Health Department. Norrisk@starkhealth.org. A verified complaint does not mean that the Board has actually smelled an issue, but means that someone has sent a notarized complaint to the Board.

Strad stated that if someone has a formal complaint about odor, call Countywide with the odor complaint, then call the Health Department as soon as you smell the odor.

Tom Odell questioned what the Board of Trustees stance is. Strad stated on his behalf, that they did everything within their powers at the time of their agreement.

When an odor call comes into Countywide, they have to fill out a form and send it to the Health Department along with a very long and detailed message.

Jill disagreed about the odor control system success. People have just given up because of how long the process takes to get anything done. She doesn’t think that the system works like it needs to.

Strad would like to have someone from the Health Department come to a meeting once every two months for updates on the situation and they agreed.

Strad thanked everyone for being cordial and would hope that we could do this again.

Strad talked to Mike Manning and he is going to Nancy Brunoni’s house on Wednesday to look into some of the issues of blasting. Mike Manning will be there the next time there is a blast.

Joe Barns also talked to Mike Manning. He downloaded the seismograph reading from the date of Buckeye’s biggest charge and it was only 88% of their allowable. A man from ODNR said it went up to 148 which exceeds their allowable of 132.

Strad told Joe to call one of the Buckeye representatives that were at the meeting. He would like them to set up a meeting to meet with Joe and review his property damage.

New Business

Anstine talked about using slag and is currently in the process of getting pricing.

A motion was made by Baum to accept Barb Harding to the BZA. Second by Strad.

Baum would like to have Steve Diloretto(Union Representative) to a meeting to discuss the labor contract. They agreed to have a special meeting to review and negotiate contract with Steve Diloreto. A motion was made by Anstine to have the meeting on April 18th at 6:00. Second by Baum.

Baum also talked about the vote on the annexation. It will be a close vote by the residents on whether they get annexed into the village.

Strad received the new 5 year plan by the Waste District and the Board will need to review it and vote whether to approve it within 90 days.

Resolution #05-2005 was passed accepting the following 2005 Permanent Appropriations.

A motion was made by Baum to accept the above resolution for the 2005 Permanent Appropriations as presented by the Clerk.

Zoning

Sharon Perrine went over the zoning report.

The Daulinger’s seem to have been working on cleaning up the property. The camper is gone and quite a bit of the trash is gone.

Stanley Miller Zoning Appeals meeting is coming up on April 13th. A judge reconsidered the case, but again ruled in the favor of the Township.

Strad stated that the 30 days to adhere to the agreement has expired, and he should have to start paying a fine of $100 a day.

Knox stated that as the financial liaison for the township, he expressed his concern over Stanley Miller Construction possibly requesting a loan from the Township for $5,000 due to him not having the finances available to pay for the fence that is in the agreement. He went on to state that if this is an option, he would want to review the books just like a financial institution would need to do to make sure that they would indeed be able to pay back such a loan.

There will be an extra spring clean up day on April 23rd .

Road Report

Pahanish read the road report.

Patched some holes.

Brush on Seamen and Bowmont.

Worked on trucks.

Had to buy $4,500 worth of posts.
