BOARD OF APPEALS MEETING

November 1, 2005 – 7:00 p.m.

Board members present were Audrey Malavite, Nancy Snyder and Louis Grooms, presiding.  Also present was Alternate, as well as Zoning Inspector, Sharon Perrine and Zoning  Secretary, Carol Barto and five concerned citizens.

 

Mr. Grooms opened the meeting at 7:00 p.m., introducing the Board members.  The Legal Ad was read by Audrey Malavite.

 

APPEAL #323

 

John W. Ott is requesting a variance of  324 square feet to split the property at 9798 Cleveland Ave. S.E., Magnolia, Ohio.  Mr. John Ott explained his intentions to split the lot into two parcels and have spent over $1,000 to have it surveyed only to find out that the one parcel did not meet the Township zoning minimum requirements of 20,000 sq. ft. thus he is requesting a variance because the parcels have sewer and natural gas available and he intends to sell as two lots.

 

Mrs. Jacqueline Faverty, who resides next door to the Farber Road property expressed her concerns about the flooding of the lot, and if someone built a house it might change the lay of the land and would cause them flooding problems from the stream on the property.   Zoning Inspector Perrine stated that the Board did not have authority over such a problem and she needed to talk to the Trustees/Road Supervisor concerning such problems.  No other objections were offered from the audience.

 

The Board deliberated.  A motion was made by Audrey Malavite to grant variance of 324 sq. feet.  Seconded by Nancy Snyder 

 

 

VOTE:                                   Nancy Snyder voted in favor of granting the variance.

 

                                                Audrey Malavite voted in favor of granting the variance.

 

                                                Louis Grooms voted in favor of granting the variance.

 

The vote was unanimous to grant the variance.

 

 

OTHER BUSINESS:

 

None was discussed.

 

Nancy Snyder made a motion to adjourn the meeting.  Seconded by Audrey Malavite at 7:23 p.m.
