BOARD OF APPEALS MEETING

August 30, 2005 – 7:00 p.m.

Board members present were Bob Burkhart, Jerry Eibel, Audrey Malavite, Nancy Snyder and Louis Grooms, presiding.  Also present were Alternates, Bob Miller and Barbara Harding, as well as Zoning Secretary, Carol Barto and three concerned citizens.

 

Mr. Grooms opened the meeting at 7:00 p.m., introducing the Board members.  The Legal Ad was read by Audrey Malavite and Mr. Grooms asked if Mr. or Mrs. Gibbons was present and asked him to explain his plans.

Mr. Gibbons explained that they are in the process of buying approximately 9 acres of land presently owned by U. S. Ceramic Tile Company and is zoned for industrial use.

He did not, at this time wish to change the zoning but wanted to build a dwelling on the property.  He also stated that they were presently living in a mobile home on the property, which would be removed, once they had built the house.

 

Bob Burkhart asked where the house would be situated on the property and if it would be the setback requirements for a dwelling.  Mr. & Mrs. Gibbons showed the Board on the map where the house would be located and the Board was satisfied that it would indeed meet the setback requirements of Zoning. 

 

Jerry Eibel asked the time frame they were looking at to build the new house and move out the mobile home.  Mr. Gibbons said as soon as the purchase and paperwork could be completed they would begin construction and as soon as the construction was completed they would have the mobile home removed. 

 

Bob Burkhart made a motion to grant the variance to construct a dwelling in a I-2 Industrial District, with the Condition that the mobile home be removed immediately after construction is completed.    Seconded by Audrey Malavite.

 

 

VOTE:                                   Nancy Snyder voted in favor of granting the variance.

 

                                                Audrey Malavite voted in favor of granting the variance.

 

                                                Bob Burkhart voted in favor of granting the variance.

 

                                                Jerry Eibel voted in favor of granting the variance.

 

                                                Louis Grooms voted in favor of granting the variance.

 

The vote was unanimous to grant the variance to construct a dwelling in an I-2 Industrial District, with the condition the mobile home be removed immediately after construction is completed.

 

 

 

OTHER BUSINESS

 

Jerry Eibel that Scott Findlay, of 6110 Breezehill Rd. S.W. who had been granted a variance August 28, 2001 to reside in a current dwelling while he constructs a new house.  On August 3, 2004, he was granted a year’s extension of the variance, provided he re-obtained all the necessary permits and completed the new house and tore down the old house by August 28, 2005.  Although he has made progress on the new construction, as of this date, he has not completed the new house and is still living in the old house.  

 

Bob Burkhart suggested that the Secretary ask the Zoning Inspector to talk to Mr. Findlay and review his progress and report back to the Board, and if she feels it necessary, bring him back to the board for review. 

 

The Board members were in agreement and asked that Ms. Perrine investigate and report back to the Board.

 

Jerry Eibel made a motion to adjourn the meeting at 7:18 p.m.  Seconded by Nancy Snyder.
